1. Agreement to Terms

These Terms of Use (“Terms”) govern your access to and use of the AlfinaAI website, platform, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Service.

2. About AlfinaAI and the Service

AlfinaAI provides tools for stock analysis, data visualization, and the generation of algorithmically-driven investment theses based on market data and other inputs.

The Service is intended for informational, educational, and research purposes only. AlfinaAI does not provide personalized investment advice, recommendations, or brokerage services, and is not acting as your investment adviser, fiduciary, or broker‑dealer.

3. Eligibility and Accounts

You must be at least 18 years old and capable of entering into a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

To access certain features, you may be required to create an account and provide accurate, current, and complete information. You are responsible for:

Maintaining the confidentiality of your login credentials
Restricting access to your account and devices
All activities that occur under your account

You must promptly notify us of any unauthorized use of your account or any other breach of security.

4. Subscription Plans and Payments

Certain features of the Service may be offered on a paid subscription basis or on a pay-as-you-go basis. Pricing, billing intervals, and included features will be described at the time of purchase or upgrade.

Fees for monthly subscriptions are billed in advance at the start of each billing period and are generally non-refundable, except as required by law or as described below.
Pay-as-you-go report fees are charged upon successful report generation. You are not charged if a report fails to generate due to a technical error on our end.
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date through your account settings. You will retain access through the end of the paid period after cancellation and will not be charged again.
We may change prices or plan features from time to time, with notice where required by applicable law.
If you experience a billing issue or believe you were charged in error, contact us at support@alfina.ai and we will work to resolve it promptly.

You authorize Stripe, Inc., our third-party payment processor, to charge your selected payment method for all applicable fees and taxes.

4.1 Payment Security

All payment transactions on AlfinaAI are processed by Stripe, Inc., a PCI-DSS Level 1 certified payment processor — the highest level of payment security certification available. AlfinaAI does not store, transmit, or have access to your full credit card number, CVV, or other sensitive payment credentials. Your payment information is submitted directly to Stripe’s encrypted servers and is governed by Stripe’s Privacy Policy.

5. License and Permitted Use

Subject to your compliance with these Terms, AlfinaAI grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal or internal business research purposes.

You agree that you will not:

Copy, modify, or create derivative works based on the Service
Reverse engineer, decompile, or attempt to extract source code from the Service
Use any automated system (scrapers, robots, spiders) to access the Service except as expressly permitted in writing
Bypass or circumvent any security or access-control measures
Use the Service to build a competing product or service, or to benchmark in a manner harmful to AlfinaAI

6. User Content

You may input or upload data, text, tickers, notes, and other materials into the Service (“User Content”), including the investment theses you generate.

You retain all rights to your User Content, subject to the license below.

By submitting User Content, you grant AlfinaAI a worldwide, non-exclusive, royalty-free license to host, store, process, display, and use such content:

To provide and maintain the Service
To generate analysis and theses at your direction
To improve and train our models and features (in de-identified or aggregated form where possible)

You represent and warrant that you have all necessary rights to submit User Content and that such content does not infringe the rights of any third party or violate any law.

7. No Investment Advice or Recommendations

The information, analytics, and investment theses generated or displayed through the Service are for informational and educational purposes only.

NOTHING ON THE SERVICE CONSTITUTES, OR SHOULD BE INTERPRETED AS, INVESTMENT ADVICE, INVESTMENT RECOMMENDATIONS, AN OFFER, OR A SOLICITATION TO BUY OR SELL ANY SECURITY, FINANCIAL INSTRUMENT, OR INVESTMENT STRATEGY.

AlfinaAI does not take into account your individual financial situation, objectives, or risk tolerance, and no communication from AlfinaAI should be considered personalized investment advice or a basis for making investment decisions. You are solely responsible for your investment decisions and should consult a qualified financial adviser before making any investment.

7.1 AI-Generated Content

Investment theses and analysis generated by AlfinaAI are created using artificial intelligence models trained on publicly available data. Outputs may contain inaccuracies, biases, or outdated information. Always verify AI-generated content independently before making any investment decisions.

AlfinaAI does not guarantee the accuracy, completeness, or reliability of AI-generated content. Use at your own risk.

8. Market Data and Third‑Party Content

The Service may display or rely on market data, news, or other content provided by third‑party data vendors and APIs. Such data may be delayed, incomplete, or inaccurate.

NEITHER ALFINAAI NOR ITS DATA PROVIDERS GUARANTEE THE ACCURACY, COMPLETENESS, TIMELINESS, OR AVAILABILITY OF ANY MARKET DATA OR OTHER THIRD‑PARTY CONTENT, AND YOU USE SUCH INFORMATION AT YOUR OWN RISK.

9. Prohibited Activities

You agree not to use the Service to:

Violate any applicable law, regulation, or third‑party rights
Upload or transmit malicious code, viruses, or harmful scripts
Harass, abuse, or harm other users
Engage in any form of market manipulation or fraudulent activity
Attempt to derive or reconstruct the underlying models or datasets beyond what the interface exposes

10. Intellectual Property

The Service, including all software, models, algorithms, visual design, text, graphics, trademarks, and logos, is owned by AlfinaAI or its licensors and is protected by copyright, trademark, and other laws.

Except as expressly permitted in these Terms, you may not use any AlfinaAI trademarks, branding, or proprietary materials without prior written consent.

11. Feedback

If you provide feedback, suggestions, or ideas about the Service (“Feedback”), you agree that AlfinaAI may use such Feedback without restriction or compensation to you, and you hereby assign all rights in such Feedback to AlfinaAI.

12. Disclaimers

THE SERVICE AND ALL CONTENT, INCLUDING ANY INVESTMENT THESES OR ANALYSIS, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, ALFINAAI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR‑FREE, SECURE, OR COMPATIBLE WITH YOUR SYSTEMS, OR THAT ANY DEFECTS WILL BE CORRECTED.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ALFINAAI OR ITS AFFILIATES, OFFERS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, ALFINAAI'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO ALFINAAI FOR ACCESS TO THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to indemnify, defend, and hold harmless AlfinaAI and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

Your access to or use of the Service
Your violation of these Terms
Your violation of any law or third‑party right
Your User Content or investment decisions

15. Term, Suspension, and Termination

These Terms remain in effect while you access or use the Service. We may suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, including if we reasonably believe you have violated these Terms or are using the Service in a way that could cause harm.

Upon termination, your right to access or use the Service will cease, but provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, and indemnities) will remain in effect.

16. Changes to the Service and to these Terms

We may update or modify the Service from time to time, including by adding or removing features. We may also update these Terms. When we do, we will revise the “Last updated” date above and, where required, provide additional notice.

Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-laws principles, except where otherwise required by applicable law.

Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of such courts. You and AlfinaAI waive any right to a jury trial to the extent permitted by law.

18. Export and Compliance

You agree to comply with all applicable export control and sanctions laws. You may not access or use the Service if you are located in a jurisdiction or on any sanctions list where such access would be prohibited under U.S. or other applicable law.

19. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

These Terms, together with the Privacy Policy and any other referenced policies, constitute the entire agreement between you and AlfinaAI regarding the Service and supersede any prior agreements or understandings.

You may not assign or transfer these Terms without our prior written consent. AlfinaAI may assign these Terms in connection with a merger, acquisition, or sale of assets.
